Addendum to Rental Agreement for US Residents<\/h5>\n\n\n\n

<\/p>\n\n\n\n

This ADDENDUM (\u201cAddendum\u201d) to the rental agreement number (\u201cRental Agreement\u201d) by and
between Bargain Car Rentals Australia anywhere In The World (the \u201cRental Company\u201d) and the
Renter, whose name appears on the vehicle Rental Agreement to which this Addendum relates
and who resides within the United States of America or one of its territories, is made effective as
of the date the Rental Agreement is executed by Renter (\u201cEffective Date\u201d).

The obligations and rights established in this Addendum are entered by and between the Renter
and PurCo Fleet Services, Inc. (\u201cPurCo\u201d), a Utaxh corporation located at 136 S. Main Street,
Spanish Fork, Utah 84660. Phone number 888-787-2688.<\/p>\n\n\n\n

    \n \t
  1. Assignment of Claims: <\/u><\/strong>The Renter hereby acknowledges that he\/she will be financially\nresponsible for any and all claims arising out of physical damage to the rental vehicle not\notherwise covered by any damage waiver(s) if purchased (\u201cPhysical Damage Claims\u201d). The\nRenter acknowledges and agrees that this Addendum shall govern all Physical Damage Claims.\nThe Physical Damage Claims are automatically assigned to PurCo. Renter acknowledges and\nagrees that, except as otherwise mandated by governing law, the following shall apply:\n<\/li>\n
  2. Physical Damage: <\/u><\/strong>Regardless of fault and subject to the terms and conditions of the\ndamage waiver(s) (if purchased), Renter agrees to be responsible for all damage to or loss of\nthe Vehicle during the rental period, as demonstrated by a repair estimate and\/or appraisal,\nresulting from any cause, including, without limitation, damage caused by collisions, weather,\ntheft, vandalism, road conditions and acts of nature.\n
  3. In the event of Physical Damage, Renter also agrees to be responsible for the following:\n
      \n \t
    1. Diminution of Value: <\/u><\/strong> For Physical Damage Claims where the Rental Company\ndetermines that the Vehicle is repairable, the amount of \u201cdiminution of value,\u201d if any, shall\nbe payable to PurCo as established by an independent, third-party estimate or valuation\nobtained by PurCo and provided to Renter.<\/li>\n \t
    2. Loss of Use: <\/u><\/strong> For any Physical Damage Claims, \u201closs of use,\u201d or a term equivalent\nthereto, shall be payable to PurCo without proof of fleet utilization to any degree, rental\nof a substitute vehicle, actual loss, lost profit, or lost opportunity to earn profit. Loss of\nuse shall be calculated based solely on the number of days that the vehicle is unable to\nbe used multiplied by the daily rental rate set forth in the Rental Agreement. For\npurposes of the loss of use calculation, one day is equal to four labor hours, two\nweekend days are added for every five repair days, and three administrative days are\nadded for the time needed to obtain an estimate, take the vehicle to the shop, and\nretrieve the vehicle.<\/li>\n \t
    3. Administrative Fees: <\/u><\/strong> For any Physical Damage Claims, the Administrative Fee, as\nfound in the Rental Agreement Terms and Conditions, is payable to PurCo in US Dollars\n(USD) based on the damage repair estimate (as converted to USD) as follows, which\nRenter agrees is reasonable:\n
        \n
      1. $0-250=$50;<\/li>\n
      2. $251-500=$75;<\/li>\n
      3. $501-750=$100;<\/li>\n
      4. $751-1500=$150;<\/li>\n
      5. $151-2500=$200;<\/li>\n
      6. $2501 and above=$250.<\/li><\/ol><\/li>\n
      7. Total Loss: <\/u><\/strong> In the event the Rental Company determines the damage to the Vehicle\nconstitutes a total loss, Renter shall be responsible for the fair market value of the\nVehicle, less salvage, if any.<\/li>\n
      8. Towing\/storage: <\/u><\/strong> Towing, storage, and impound charges and other reasonable\nincidental and consequential damages.<\/li>\n
      9. Attorney\u2019s Fees:<\/u><\/strong> In any action to enforce the provisions of this Agreement, the\nprevailing party shall be entitled to recover its costs, including reasonable attorney\u2019s\nfees.<\/li>\n<\/ol>\n<\/li>\n
      10. Governing Law, Venue, and Jurisdiction: <\/u><\/strong>Renter hereby acknowledges and agrees that,\nnotwithstanding any provision to the contrary in the Rental Agreement, that the Jurisdiction,\nVenue, and the law governing the interpretation and performance of the Rental Agreement and\nthis Addendum, as it relates solely to Physical Damage Claims, shall be the State or Territory of\nthe United States in which Renter has a residence (\u201cresidence\u201d shall mean the physical address\nappearing on Renter\u2019s driver\u2019s license or passport that Renter presents to the Rental Company\nin connection with the execution of the Agreement) as of the Effective Date, without regard to\nany conflicts of law analysis, and nothing in this Addendum shall be construed to the contrary.\n<\/li>\n
      11. Renter hereby further acknowledges and agrees:\n
          \n
        1. Rental Company has not delegated any\nduties or assigned any obligations to PurCo under the Rental Agreement;<\/li>\n
        2. Rental Company\nhas undertaken no duties or obligations in this Addendum;<\/li>\n
        3. The exclusive jurisdiction and\nvenue for all affirmative claims brought by Renter against Rental Company under any theory of\nlaw shall be as set forth in the Rental Agreement; and <\/li>\n
        4. Rental Company has not consented to\nor subjected itself to jurisdiction in any other jurisdiction or venue by virtue of this Addendum.<\/li><\/ol><\/li>\n
        5. Renter shall not be entitled to offset any damages it may be awarded from Rental Company\nagainst any amounts owing for Physical Damage Claims.<\/li>\n
        6. The invalidity of any portion of this Addendum shall not prevent the remainder from being\ncarried into effect.<\/li>\n
        7. This is the entire agreement between Renter and PurCo.<\/li>\n<\/ol>\n\n\n\n
